Photo: BTPThe Law amending and supplementing a number of articles of the Law on Legal Aid in 2026 passed by the National Assembly marks an important shift in thinking about ensuring human rights, civil rights and peoples ability to access justice in the new period. The notable highlight of this amendment is expanding the number of people receiving legal aid from 7 groups to 14 groups. This is considered a meaningful humanitarian step, consistent with practical requirements and the orientation of building a justice system close to the people, serving the people. According to the new regulations in Article 7 of the Law, in addition to the groups that have previously enjoyed legal aid such as people with meritorious services to the revolution, poor households, children, people with disabilities, and ethnic minorities in areas with particularly difficult socio-economic conditions, the Law has added many new groups of subjects. Among them are low-income workers. low is the accused or victim in the case; people suffering from domestic violence; people facing unexpected difficulties due to natural disasters or fires; people from 16 years old to under 18 years old participating in proceedings; victims of human trafficking; Individuals who suffer damage in cases are subject to the States compensation liability; foreigners according to international treaties to which Vietnam is a member. The expansion of the number of people eligible for legal aid represents a shift in legislative thinking, from administrative support to an approach that ensures access to justice for disadvantaged groups in society. One of the highly appreciated new points is that the Law gives special attention to minors participating in legal proceedings. Accordingly, people from 16 years old to under 18 years old who are denounced, prosecuted, held in emergency cases, accused, victims, witnesses or people undergoing diversion measures are eligible for legal aid. This regulation contributes to concretizing the policy of strengthening the protection of children and juveniles in judicial activities, in accordance with the spirit of the Law on Juvenile Justice and international commitments to which Vietnam participates. Along with that, expanding legal aid to victims of domestic violence, victims of human trafficking, and people facing difficulties due to natural disasters and fires also aims to support groups at high risk of physical and mental harm, helping them protect their legitimate rights and interests. Not only does it expand the subjects of legal aid, the amended Law also strengthens the States responsibility in bringing legal aid services closer to the people. According to the new regulations, the state budget will prioritize supporting localities that have not yet been able to balance their own budgets to carry out typical, complex legal aid cases. At the same time, a number of procedures are designed to be more flexible, allowing for immediate handling of cases in cases where the statute of limitations for lawsuits is about to expire, the trial date is approaching, or there is a risk of directly affecting the legal rights and interests of legal aid recipients. It can be seen that the new regulations in the Law amend and supplement a number of Articles of the Law on Legal Aid 2026 not only contribute to improving legal policies, but also clearly demonstrate the orientation of building a people-centered justice system, ensuring that everyone, especially disadvantaged groups, have the opportunity to access justice and protect their legitimate rights and interests.DA
