Mr. Tran Huu Dung (Thanh Hoa) has 14 years and 8 months of social insurance and quit his job from August 2024. Due to busy family work, he did not go to work to hand over the work. From September 2024, he quit his job without salary. Mr. Dung asked, did he receive one -time social insurance? Is it entitled to pension? In this regard, the social insurance of Thanh Hoa province answered as follows: Regarding the one -time social insurance regime, based on the provisions of Clause 1, Clause 2, Article 70 of the Law on Social Insurance No., the employee has terminated to participate in the social insurance but has a one -time social insurance to be entitled to social insurance once. No. 41/2024/QH15, so it has not been resolved one -time social insurance. After terminating the social insurance participation and if required, the social insurance agency will consider settling the regime as prescribed. Regarding the retirement regime, because Mr. Dung has only 14 years and 8 months of social insurance payment (less than 15 years of social insurance payment as prescribed in Clause 1, Clause 2, Article 64 of the Law on Social Insurance No. 41/2024/QH15), Mr. Dung is not eligible for pension. When Mr. Dung meets the eligibility for 15 years of social insurance and retirement age as prescribed, he will be entitled to pension.
