📋 Tender Overview
Buying land, a house or an apartment is a serious step that requires a thorough check of the legal purity of the property. The basic source of information is the Unified State Register of Real Estate. The extract contains data on the characteristics of the object, registered rights, encumbrances and areas with special conditions of use. As Sergei Gavrilov, Chairman of the State Duma Committee on Property, Land and Property Relations, notes, some personal data is now available to a limited circle of people, so obtaining it may require the participation of the owner or a notary. Land plots: key risks When choosing a plot, it is important to check its status. For example, if the land is leased, the agreement may survive a change of owner. It is also worth considering areas with special conditions: water protection or sanitary zones may impose a ban on construction. From March 1, 2025, registration of rights to plots without established boundaries in the Unified State Register of Real Estate will be suspended. This means that the seller will not be able to re-register the property until he carries out land surveying, which requires time and the involvement of a cadastral engineer. Pay attention to the presence of a protective record indicating the impossibility of registration without the personal participation of the owner. If it is worth it, the transaction can only be carried out in the presence of the seller himself. It is also important to check for easements, liens or arrests that may limit your rights to use the land. When checking the legal purity of an object, you need to find out whether the property is jointly owned - in this case, the notarial consent of the spouse is required. Transactions involving minors or incompetent persons require special control. If maternity capital was used when purchasing a home, you need to make sure that the children were allocated shares. Otherwise, the deal may be challenged in court, and it will be extremely difficult to return the money spent. Inspection of houses and apartments For residential buildings, it is critically important that the actual parameters (area, number of floors, extensions) match the information in the Unified State Register of Real Estate. Unauthorized renovations can create problems when applying for a mortgage or insurance. In the case of apartments, experts advise studying the history of transfers of ownership. Frequent changes of owners or the presence of encumbrances, such as a lifelong maintenance agreement with dependents, require increased vigilance. Checking the Unified State Register alone is not enough for complete security. Experts recommend further studying the seller through databases of court decisions, the bankruptcy register and the bank of enforcement proceedings. You should be especially wary of urgent sales at a price significantly below the market price. Such transactions may hide attempts to withdraw property before bankruptcy or the presence of large debt obligations, which in the future threatens the new owner with the loss of real estate.
