📋 Tender Overview
By registering the construction of a property, the property acquires greater value and you can access mortgage loans and other financing opportunities. The factory declaration constitutes an act that can be registered in the Sunarp Property Registry, through which a construction, extension or existing building on a property is registered. If, after carrying out construction on land and registering the factory declaration, you carry out new constructions on the property, these changes must be registered through a factory extension. This procedure allows new built areas to be incorporated into the Registry, such as a second floor, additional rooms or any other extension, so that the property information faithfully reflects the reality of the property.
An important fact, namely, is that, as a result of the recent modifications to several articles of the Property Registry Registration Regulations, these procedures have been simplified. Now they are simpler. For example, if the property is in the name of a marital partnership, the signature of either spouse on the documents supporting the registration is sufficient.
Likewise, when the property belongs to several co-owners, it is no longer necessary for them all to sign. It is sufficient with the signature of those who represent the absolute majority, as established in the Civil Code.
In which cases should a factory declaration be requested?
New construction: When a house, building or premises (among others) is built from scratch and the work is already finished.
Extension: When new spaces are added, such as another floor or additional rooms.
Remodeling: When important changes are made to the existing construction, such as modifying its structure or distribution.
