Implementing the direction of the Government and the Prime Minister on promoting decentralization and delegation of power with the motto "locality decides, locality does, locality takes responsibility", recently the Ministry of Construction has focused on strengthening institutional improvement, promoting decentralization and delegation of power in the fields of state management of the Ministry.
In particular, the Draft Law on Urban Development Management is identified as an important legal basis for implementing the policy of decentralization and delegation of power in the field of urban development.
The national urban system with more than 900 cities has a very rich and diverse development context according to 6 socio-economic regions. The cities have also undergone an investment and development process associated with natural characteristics and historical, economic, cultural and social factors. Those characteristics and specificities create unique resources for each locality.
Therefore, decentralization and delegation of power to localities in the development process will promote development resources and create development space. Each locality will base on its practical conditions and needs to proactively develop plans, programs and solutions to improve the effectiveness of urban development management, towards the goal of sustainable development of Vietnam's urban system.
Each urban area has an urban planning to guide development for a period of 20 to 25 years, possibly with a long-term vision of up to 50 years. To ensure compliance and synchronization with the long-term vision of the planning during the planning implementation process and, more importantly, to integrate public investment with attracting development resources from society and the community to promote the overall effectiveness of resources, the Law on Urban Development Management has proposed that localities issue urban development programs to implement approved urban planning, identifying priority tasks associated with the deadline for completing the urban infrastructure framework in each phase with each urban development area.
The program content will also incorporate plans for synchronous development of urban infrastructure, urban underground space and urban renovation plans... It can be said that this is a tool that plays a role in synchronously regulating and unifying the implementation of approved planning, while at the same time publicly and transparently disclosing information about the expected implementation of state responsibilities.
Accordingly, social and market investment will develop more proactively and transparently, limiting the situation of excess due to investment that is in line with planning but not close to demand or vice versa, the situation of infrastructure framework not meeting actual development needs.
From many years of experience in managing the development of large urban areas in Ho Chi Minh City, Dr. Vo Kim Cuong, former Deputy Chief Architect of the city, emphasized the need to organize urban development according to the urban development program to limit fragmentation and lack of uniformity. In addition, the comments of the Ho Chi Minh City Department of Construction suggest that for the urban development program of a large-scale special urban area, the focus should be on completing the framework infrastructure and criteria and standards for urban classification. For urban renovation programs and plans, underground space development can be approved separately.
The Draft Law on Urban Development Management has assigned localities to decide on the entire process of establishing, appraising, and approving the Urban Development Program, determining the order of priority and resources for implementing the synchronous development of urban framework infrastructure, technical infrastructure, social infrastructure, urban development areas, and urban renovation areas.
