📋 Tender Overview
The State Secretariat for Migration (SEM) can evaluate electronic data carriers from asylum seekers from April 1, 2025. The necessary adjustments in the Asylum Act and the associated regulations that the Federal Council passed in May 2024 come into force on this date. An evaluation is made if identity, nationality or travel path cannot be determined in any other way.
In around 50 percent of asylum seekers, identity cannot be determined without any doubt according to previous experience. In order to determine their identity, nationality or travel path, the SEM can evaluate data from mobile phones, computers and other data carriers from asylum seekers from April 1, 2025. As part of their obligation to cooperate and in the execution of the removal, the asylum seekers are obliged to allow the personal data to be processed on their electronic data carriers. However, in each individual case, the SEM must check beforehand whether the evaluation is necessary and proportionate.
Specialist specialists of the SEM first view the data as part of a three -month test phase in the two federal asylum centers in Basel and Chiasso. The introduction in all federal asylum centers with procedural function is provided for after evaluating the test phase.
