π Tender Overview
Licenses will also be revoked only in relation to those points where violations are detected. The bills were adopted by the State Duma in the first reading.
Currently, a state fee of 65 thousand rubles is paid for the issuance or extension of a license for the retail sale of alcoholic beverages for each year of the license's validity. This amount does not depend on the number of facilities in which the organization sells alcohol. It is proposed to establish that the state fee for a license (for issuance or extension) is paid for each retail or catering facility in the amount of 20 thousand rubles for each year of the license's validity.
The State Duma adopted the bill with such amendments in the first reading ( 506452-8 ). The bill was initiated by a group of deputies. As a result, for small businesses that have up to three points, the fiscal burden will decrease. If there are four or more points, it will increase. Currently, the unbearable size of the state duty for small businesses leads to the fact that they prefer to work illegally - without a license, the authors of the bill indicated.
It has also been proposed to introduce a rule that when reissuing a license for the retail sale of alcoholic beverages due to an increase in the number of retail outlets or catering facilities, 20 thousand rubles are paid for each full (incomplete) year remaining until the end of the license term, for each additional facility.
There is a conclusion of the responsible committee on the draft law. The committee pointed out the need to differentiate between the issues of increasing the number of trading places and changing their addresses - will the "moved" points be considered new for these purposes? Here the committee sees the uncertainty arising. The government also expressed similar claims to the draft.
The committee also noted that it requires discussion of the issue of using such vague terms in the legislation as "trading facility" and "catering facility". The draft law does not specify the types of trading facilities (stationary or non-stationary), or the types of catering facilities. So these concepts can be replaced by the term "place of activity specified (indicated) in ... the register ... of licenses ...". The relevant amendments will most likely be made to the text of the draft law by the second reading, as is usually the case.
In addition, another bill, 506793-8 , simultaneously amends the law on state regulation of alcohol production and circulation. This bill provides for the possibility of suspending or revoking a retail alcohol license for one facility, if violations are detected in only one retail facility or catering facility. For large businesses, this will reduce the risks of revocation of the license for the entire retail chain. This bill was also adopted in the first reading.
