The document introduces into the Civil Code a new object of intellectual rights - geographical indication.A geographical indication GI is a designation that allows you to identify a product as occurring from a specific territory. Its characteristics are largely determined by the origin. Geographical indications include Krasnodar tea Bashkir honey Dulevsky porcelain and Tula gingerbread.As previously reported the geographical indication will act on a par with the existing appellation of origin AO. Only for registration of a geographical indication it will be necessary that at least one of the stages of production affecting the formation of the specific characteristics of the goods be carried out in the specified territory. This distinguishes a new type of intellectual right from ATP for which all stages of production of goods must be carried out in the same territory.A geographical indication may be registered by one or several citizens one or several legal entities and also by an association union or other association of persons whose creation and activities do not contradict the legislation of the country of origin of goods the bill reads for the second reading.The use of state institutions will consider in particular its placement on goods labels packages that are sold or offered at exhibitions and fairs in Russia.A geographical indication is protected throughout the lifetime of the possibility to produce a product that meets the established requirements. The exclusive right to a geographical indication will be valid for 10 years from the date of filing the application with Rospatent and with the possibility of further extension upon the application of the copyright holder. The exclusive right will be terminated in case of loss of the special characteristics of the product.
