π Tender Overview
Brasilia (DF)-Improving the life of those who depend on public transport every day is the main objective of the legal framework of public public transport, a public hearing theme that was attended by the Ministry of Cities on Thursday (14), in the House of Representatives.
This is a project that will allow more investments and, consequently, greater qualification of the services that benefit the user. The population needs much more lines, punctuality and quality embedded.
The proposal also wants to make public transport more integrated, accessible and efficient, as well as offering local managers a set of clear guidelines for planning and operating the system. All this without taking the autonomy of states and municipalities, and giving them the necessary tools to ensure quality service.
The details of the legal framework
The text is divided into four axes. The first deals with the organization and guidelines and proposes the creation of a unique public public transport network, with regular lines and fixed tariffs, complementary services for further areas and on demand services.
The second axis, financing, seeks to expand the ways to support the system, in order to combine users paid by users with other sources, such as advertising, exploration of areas close to terminals, public subsidies and contributions related to real estate appreciation. The proposal also encourages the use of electronic ticketing and the opening of data thinking about giving more transparency to the process.

For Secretary Denis Andia, the project represents a structural advance in the management of the sector. The user must expect the ability of new investments so that our transportation is increasingly attractive in every corner of the country. Opening this for knowledge is critical. Peoples support is important, he said.
In the hiring axis and economic regime, the legal framework proposes that the remuneration of transport companies be linked to the performance of the service, and not only to the number of passengers. Rules for financially balanced contracts have also been defined, to stimulate the renewal of the fleet for cleaner vehicles and promote the use of new technologies.
Social participation and transparency is the fourth axis. The idea is that it guarantees channels so that the population can follow and give an opinion on public transport.
This includes ombudsmen, councils and public consultations, as well as the obligation to disclose costs, quality of service and application of funds. We need to listen and contemplate people who are on the sidelines of public transport in Brazil, said Andia.
With the implementation of Marco Legal, the expectation is that states and municipalities will update their laws and contracts, reducing breaches that generate judicial disputes and improving management.
In addition to strengthening public transport as a whole, the measure makes room for innovations and supports the transition to more sustainable models.
How was the legal framework built?
The legal framework of public public transport gained form from a participatory process conducted by the National Secretariat of Urban Mobility, of the Ministry of Cities. With support from the Inter -American Development Bank (IDB), the proposal was debated with civil society organizations at the Urban Mobility Advisory Forum and submitted to public consultation between November 2022 and February 2023. During this clipping, about 840 contributions were received, which, after analysis, resulted in legal adjustments and improvements in the original text.
In 2024, with legislative activities resumed, the Ministry of Cities presented the new version to the rapporteur of PL No. 3,278/2021, in Senate and similar theme. After negotiations, the content of the legal framework was incorporated into the project, which now follows as a substitute bill. It is expected that the proposal, built at various hands, advances in the National Congress strengthened and aligned with the needs of public transport in the country.
