In addition to the criminal acts of the defendants at Thien Minh Duc Company, the prosecution also clarified the embezzlement of assets that occurred at PVOil Vung Ang. Specifically, defendant Ha Ngoc Vinh (a warehouse accountant in the Finance and Accounting Department of PVOil Vung Ang) had the task of Manage, monitor, compare and check goods data at the companys warehouses and contract warehouses. Taking advantage of his assigned powers and the loophole of using Smart accounting software that could adjust sales data without being detected, Vinh had the intention of appropriating PVOil Vung Angs gasoline. In 2016, Vinh agreed with Cao Bao Ngoc (Director of Viet Trung Company) for Vinh to sell gasoline without invoices at a price lower than the price announced by PVOil Vung Ang from 500 - 1,000 VND. copper/liter; Ngoc will pay for the goods into the personal account designated by Vinh or in cash. When Cao Bao Ngoc agrees, Vinh and Ngoc agree on the delivery and receipt of the goods by having Viet Trung Company staff place the order and receive the goods in accordance with PVOil Vung Angs procedures. For every shipment that Vinh sold without issuing an invoice, Vinh informed Ngoc not to pay for the goods to PVOil Vung Ang but to transfer the purchase money from Cao Bao Ngocs account to Vinhs account, or hand over cash. To balance the books of goods sold to Ngoc, defendant Vinh edited on Smart software to increase the amount of gasoline and oil at standard temperature of 15degC (referred to as V15) sold to many other customers at Vung Ang warehouse to be higher than the data. V15 actually exported (in which, each Vinh customer increased the volume from 200 - 400 liters, equivalent to 2 - 3% to match the thermal expansion rate of gasoline), so that the total volume of modified goods from customers was equal to the amount of V15 goods sold without invoices to Ngoc. Investigation results determined that, from December 2016 to April 2025, Vinh exported and sold without VAT invoices to Cao Bao Ngoc. 187 times, total amount of 5,095,035 liters of gasoline and oil, worth more than 94 billion VND. Defendant Cao Bao Ngoc admitted that he bought the above mentioned amount of gasoline and oil from Vinh, which Vinh gave him a discount of 4.6 billion VND. The amount of gasoline Ngoc resold to fishing boat owners in the Quang Tri area to repay Vinh more than 89 billion VND. The accusation has determined that to date, defendant Ha Ngoc Vinh has handed over to PVOil Vung Ang more than 6.2 billion VND; The remaining balance has not been recovered, Vinh claimed to have used the money from selling goods to Ngoc to gamble onlineinternet network, lost everything. Defendant Cao Bao Ngoc also voluntarily handed over 4.6 billion VND for illegal benefits to PVOil Vung Ang. Toan Thang
