However, the export of programs, radio channels, television channels or provision on digital platforms and social networks at home and abroad does not have specific regulations, leading to difficulties in management and supervision for state management agencies, and at the same time making it difficult for press agencies to increase revenue from providing program content, radio and television channels on digital platforms and social networks at home and abroad. Current regulations do not allow press agencies to have the same financial mechanisms as businesses to provide pay radio and television services, which is also a limitation, affecting the sustainable development of our countrys radio and television industry. Current regulations do not allow businesses providing pay radio and television services to arrange movie programs and entertainment sports programs into a series of continuous broadcasts to facilitate viewers and receive revenue from advertising. Reporting is a strong growing trend in the world and Vietnam is no exception to that general trend. Therefore, the development of a draft Decree on management, provision and use of radio and television broadcasting is extremely necessary to fully and promptly institutionalize the provisions of the 2025 Press Law, assigning the Government to make detailed regulations related to the management of radio and television activities and the provision and use of radio and television services. At the same time, systematize and consolidate regulations. Current laws are still appropriate, ensuring consistent and convenient application in practice; create a stable and transparent legal framework for radio and television activities; does not set new management policies, does not give rise to new administrative procedures and does not increase compliance costs for agencies, organizations and individuals. Layout of the draft DecreeThe draft Decree includes 4 Chapters, 27 Articles, detailing a number of articles of the Press Law No. 126/2025/QH15, including: - Chapter I: General provisions. This Chapter includes 03 articles (from Article 1 to Article 3) regulating the scope of regulation, subjects of application and interpretation of terms. - Chapter II: Granting and revoking licenses for radio and television activities, licenses for producing radio program channels, licenses for producing television program channels, certificates of registration to provide foreign program channels on radio and television services; program storage regime, electronic deposit and radio and television broadcasting activities in cyberspace. This Chapter includes 12 articles (from Article 4 to Article 15), in which Articles from Article 4 to Article 12 are regulations inherited from Decree No. 06/2016/ND-CP, Decree No. 71/2022/ND-CP and related Circulars with amendments and supplements to suit reality, creating conditions for radio and television management activities. Articles from Article 13 to Article 15 are new regulations developed according to the provisions of Press Law No. 126/2025/QH15.- Chapter III: Management, provision and use of radio and television services. This chapter includes 10 articles (from Article 16 to Article 25) regulating radio and television service management policies; principles of providing radio and television broadcast services; Conditions for providing pay radio and television services; granting licenses to provide pay radio and television services; amend and supplement licenses to provide pay radio and television services; revoke licenses to provide pay radio and television services; Register a list of program channels on radio and television services; receive live television signals from satellites; Documents and procedures for registering to receive live television signals from satellites and professional reports. These are the regulations inherited from Decree No. 06/2016/NDCP, Decree No. 71/2022/ND-CP with amendments and supplements to regulations to suit reality, creating conditions for the development of radio and television services. - Chapter IV: Implementation provisions. This Chapter includes 03 articles (from Article 26 to Article 28) regulating the effective date of the Decree; stipulates the abolition and replacement of relevant legal documents and regulations; stipulating the transition time for implementing the provisions of the Decree and clearly stating the responsibilities of individuals, agencies and units responsible for implementing the Decree.
