π Tender Overview
In the Chamber of Deputies, another presentation has been presented on the Proposal for Law on the Operation of the Court of Accounts, within the framework of the procedure established by the internal regulations of that parliamentary institution for this type of legislative initiatives.
This presentation, presented by the Judge and President of the Audit Chamber of the Court of Accounts, Muakuku Rondo Igambo, has focused on the chapters related to the supervisory function of that constitutional body, the obligation to render accounts as one of the fundamental pillars of public control, the procedures for auditing public assets, the accounting jurisdiction bodies, the powers of the judges of the Court of Accounts and the relations of that institution with other courts.
The audit function of the Court of Auditors refers to its technical nature, subject to the principles of legality and efficiency, the source of data, the audit procedures and audit techniques that are suitable.
During the investigation or examination of accounts, the magistrates of that court will have the power to hear any person in charge and representative of the service or body subject to their control, any manager of public funds, any manager of a public or private company or any member of an institution or control body and when the communications, information and hearings concern matters of a secret nature or on confidential elements of the management of companies contracted by a body subject to its control, the Court of Auditors will take all necessary measures to guarantee the secrecy of its investigations and observations.
This bill highlights that accountability is a duty of office and an obligation of public order, establishing the procedures for processing files, the processing of reports, deliberations, the involvement of the Prosecutors Office of the Court of Accounts for its assessments and qualifications after the adoption of the reports by the plenary session, as well as the processing of the inspection procedures to the trial chamber.
The duty of collaboration with the Court of Accounts of all natural and legal persons receiving subsidies, credits or other aid from the public sector is also established, as well as the consequences of non-compliance, indicating that accountability is a legal obligation for all subjects that manage public funds.
This bill also establishes the procedure and deadlines for accountability, according to each case, the bodies of accounting jurisdiction and their powers, as well as their limits.
Since the Court of Accounts is an organ that emanates from Parliament, parliamentarians must provide it with legal instruments that allow it to carry out its supervisory functions, which is why the Chamber of Deputies adopted this bill, which is being analyzed within the framework of the procedure established in the internal regulations of that parliamentary institution, regarding law proposals.
The audit work of the Court of Accounts, the scope of its action, as well as the results of its investigations have been widely analyzed and the doubts raised by the deputies have been clarified by the rapporteur, in a session held under the moderation of the First Vice President of the Chamber of Deputies, Maria Pelagia Abeso Tomo Nguema.
