The Government issued Decree No. 304/2026/ND-CP dated August 3, 2026, mobilizing scientific, technological and technical potential to serve the activities of the Peoples Public Security. This Decree regulates in detail Clause 2, Article 33 of the Law on Peoples Public Security on mobilizing scientific, technological and technical potential to serve the activities of the Peoples Public Security. Mobilizing scientific, technological and technical potential to serve the activities of the Peoples Public Security is the process by which the Ministry of Public Security organizes the exploitation and use of scientific, technological and technical potential of agencies, organizations and individuals that are not part of the organizational system of the Ministry of Public Security according to a plan approved by the Prime Minister to protect national security, ensure social order and safety, and fight against crime and law violations. This Decree does not regulate the following cases: (*)a) Mobilizing resources when there is a state of war, a state of emergency, when there is a risk of threatening national security, social order and safety but not to the level of declaring a state of emergency, fighting terrorism, participating in firefighting and rescue, rescuing and performing guard work; mobilize people, vehicles, and civilian equipment in accordance with the law on road traffic order and safety and the law on mobile police; mobilize means of transport and communication of agencies, organizations and individuals according to the provisions of law on the organization of criminal investigation agencies; Mobilize experts, scientists, and specialized officials in emergencies to protect national security and ensure social order and safety in cyberspace in accordance with the law on cyber security; b) Mobilize resources to participate in the development of the security industry; Mobilize the scientific, technological and technical potential of agencies, organizations and individuals to serve research, production and use of cryptography to protect state secret information in accordance with the law on ciphers; c) Mobilize requisitioned assets and confiscated assets according to civil law provisions; mobilize assets to buy and requisition according to the provisions of law on asset acquisition and requisition; Mobilizing intellectual property is subject to mandatory transfer of use rights according to the provisions of the law on intellectual property; d) Cases of resource mobilization are governed by the provisions of other specialized laws. Mobilization principles The Decree clearly states: Mobilizing scientific and technological and technical potential to serve the activities of the Peoples Public Security must comply with the authority and order according to the provisions of this Decree and for the right purposes approved by the Prime Minister in the annual mobilization plan; must effectively use the mobilized objects and not disrupt the normal operations of relevant agencies, organizations and individuals. The State encourages and creates favorable conditions for agencies, organizations and individuals to voluntarily and agree to transfer scientific, technological and technical potential to serve the activities of the Peoples Public Security; ensure the legitimate rights and interests of agencies, organizations and individuals possessing mobilized scientific, technological and technical potential; Timely and reasonable compensation for agencies, organizations and individuals possessing mobilized scientific, technological and technical potential. The scientific, technological and technical potential of agencies, organizations and individuals in accordance with the mobilization plan approved by the Prime Minister will be considered for mobilization to serve the activities of the Peoples Public Security to protect national security, ensure social order and safety, and fight against crime and law violations, except in cases where are specified in (*). The mobilization of scientific, technological and technical potential managed by the Ministry of National Defense must be agreed in writing between the Minister of National Defense and the Minister of Public Security. Agencies, organizations and individuals that mobilize scientific, technological and technical potential to serve the activities of the Peoples Public Security must comply with the provisions of law on protection of state secrets, law on intellectual property, law on personal data protection. Mobilization method Mobilizing scientific potential and technology and techniques serving the operations of the Peoples Police are implemented through the following methods:1. Voluntarily by agencies, organizations and individuals possessing scientific, technological and technical potential.2. Agreement between the Ministry of Public Security and agencies, organizations and individuals possessing scientific, technological and technical potential.3. Decision of the Prime Minister assigning the Ministry of Public Security and agencies and organizations to possess scientific, technological and technical potential. This mobilization method only applies to public assets assigned to agencies or organizations for management and use and can only be used in cases where the mobilization methods prescribed in Clauses 1 and 2 above cannot be implemented. The Ministry of Public Security reports to the Prime Minister to consider and decide to apply this mobilization method.
