π Tender Overview
The Municipal Council of Trujillo unanimously approved in an extraordinary session chaired by Mayor Mario Reyna RodrΓguez, the draft Municipal Ordinance on Regularization of Building License, Conformity of Work and Declaration of Building in the District of Trujillo.
This was prepared by the Sub-Management of Buildings of the Provincial Municipality of Trujillo (MPT) and sent for review, debate and possible approval by the Management of Urban Development, with official letter No. 175-2024-MPT and was supported by its manager Carlos Bejarano Celis.
The ordinance is for the district of Trujillo and promotes the formalization of works of existing buildings for the use of housing (single-family and multi-family), mixed uses, commerce, complementary public services (education and health at all levels) and special use zones (O.U.).
It seeks to provide facilities to those who built between January 2017 and December 31, 2023, allowing the formalization of this type of construction, whether extensions or others.
The ordinance does not include the Historic Center of Trujillo, sectors or subsectors in the condition of Monumental Zones, Urban Monuments or Surrounding Architecture and Archaeological Zones declared as such by the Ministry of Culture; properties located in areas reserved for public use (public roads, road extensions and/or that are part of the road network), risk areas classified by Civil Defense or ecological reserves and/or buildings that threaten the environment.
A study by the Peruvian Chamber of Construction (CAPECO) indicates that informality in the construction sector grew by up to 80%, so it is necessary to promote the formalization of those who started a construction process without obtaining a permit or license.
The ordinance has permissible ranges so that they can take advantage of benefits, according to the current construction regulations. Those interested will have to regularize their urban development to access this benefit program.
Law No. 27972 β Organic Law on Municipalities, states that the exclusive functions of municipalities are to regulate and grant authorizations, rights, licenses and to carry out the supervision of construction, expansion, remodeling or demolition of buildings, conformity of work and declaration of factory.
Article 34 of Law No. 29090 β Law on the Regularization of Urban Development and Buildings, as amended by Legislative Decree No. 1287, establishes that municipalities, in order to encourage the formalization of property ownership in their jurisdictions or for the purpose of encouraging real estate development, may reduce, exonerate or split the payment of such rights. provided that they constitute each municipality's own income, in application of the provisions of Article 9(9) of Law No. 27972.
