The Comptroller General identified in the Provincial Municipality of Espinar an economic damage of S 330 456 in the work Improvement of Vehicular and Pedestrian Transitability on Av. San Martn in the district of Espinar with a budget of S 2 188 175 for five extensions of term due to stoppages attributable to both the entity and the executing consortium as well as for the erroneous calculation of the extensions of term and the non-application of penalties. For these facts the alleged civil liability of six former officials was determined. As detailed in the Specific Control Report No. 026-2022-2-0387-SCE during the period from June 26 2015 to September 12 2018 officials of the entity processed and approved extensions of term due to work stoppages due to maintenance interventions executed by the municipality when the work had begun its execution and that due to the nature of the works These had to be executed beforehand. These facts allowed the contractor to request the first extension of term for 60 days the second request for extension of term was consented without the cause presented by the contractor having support the third request was consented despite the fact that the contractual term was expired allowing to extend the execution period by 94 days which led to the payment of S 75 994 for higher general expenses in favor of the contractor. Likewise the approval of the final liquidation of work allowed the payment in excess due to calculation error in favor of the contractor for higher general expenses of S 48 772 for the extensions of term n 1 n 2 n 3 n 4 and n 5 which were not supported or accredited. Finally from the review of the work notebook and the reports issued by the work inspectors and the supervisor during the execution of the work the absence of the resident was evidenced for 48 days of which only the penalty was applied for 1 day ceasing to penalize the fact for 47 days to the detriment of the entity. The control report prepared by the Institutional Control Body OCI of the Provincial Municipality of Espinar was communicated to the entity for the initiation of legal actions against the officials and public servants included in the irregular acts and is published on the institutional portal of the Comptrollers Office. www.gob.pecontraloria.
