📋 Tender Overview
Within the framework of the delegation of powers granted by the Legislature, the Executive today promulgated Legislative Decree No. 1582, with the purpose of strengthening and applying adequate immigration control, establishing expeditious administrative sanctions of expulsion of offending foreigners and promoting the formal entry of foreign citizens with a labor relationship in their country.
The law, approved yesterday in a session of the Council of Ministers, incorporates various aspects with a new focus on security and sovereignty. It also facilitates coordinated work between Migrations and the National Police to enable efficient coordination and effective interoperability with the Ministry of Foreign Affairs, transport companies and accommodation services, in order to guarantee internal order, public order and national security.
Along these lines, the new decree establishes an Exceptional Special Administrative Sanctioning Procedure (PASEE), a process that guarantees the sanction of effective expulsion with impediment to re-entry into the country for up to fifteen years, for those foreigners who entered the country without carrying out immigration control and those who carry out activities that put at risk or threaten citizen security.
This special procedure can be carried out in person or virtually, through a single hearing, establishing an administrative retention of up to 24 hours that includes the immigration control stage in charge of the Aliens Division of the National Police.
Digital Nomad
Likewise, Legislative Decree No. 1582 incorporates the temporary migratory status, called Digital Nomad, so that foreigners with an employment relationship with a company not domiciled in the national territory, can carry out their activity in the country, contributing to its development, through computer or telematic means and systems, thus generating tourism and the activation of our economy.
This law, which consolidates immigration reform, is articulated with legislative decrees 1573 and 1574 which, in turn, amend the Penal Code and the Code of Criminal Procedure, respectively, also approved by the Executive, to combat foreign crime in our country from the criminal and administrative spheres.
