π Tender Overview
The Law on Dissemination and Legal Education (amended) project was considered and commented on by the National Assembly Standing Committee at the 4th session held on the afternoon of July 14. Download Minister of Justice Hoang Thanh Tung presented the Proposal on the law project at the meeting. The presentation on the Law project presented by Minister of Justice Hoang Thanh Tung said that the development of this Law aims to overcome the limitations, difficulties and problems of the current Law; institutionalize the Partys policy on innovating and improving the quality and effectiveness of legal education dissemination (PBGDPL); ensure the right to access legal information, the right to contribute comments, feedback, and recommendations on policies and laws; enhance the application of information technology and digital transformation; contributing to building a culture of compliance with the law and perfecting the socialist rule-of-law state of Vietnam. The draft Law includes 5 chapters with 42 articles (remaining the same number of chapters and increasing 1 article compared to the 2012 Law on Legal Handling; in which the content of 40 articles is amended and completed, basically keeping the content of 1 article and adding 1 new article). Draft Law on Legal Handling (amended) regulates rights, obligations, subjects, content, form, state management responsibilities, responsibilities of agencies, organizations and individuals in policy communication and legal dissemination; At the same time, it applies to agencies, organizations and individuals in Vietnam and Vietnamese people abroad related to PBGDPL. At the same time, the draft Law inherits and completes regulations on the responsibilities of ministries, ministerial-level agencies, Peoples Courts, Peoples Procuracy, State Audit, local authorities, Fatherland Front, organizations and unions... to clearly define responsibilities and mobilize the political system to participate in legal reform. Preliminary examination of the Law project, Chairman of the Law and Justice Committee Phan Chi Hieu stated clearly, Standing Committee and Standing agencies of the National Assembly Approved the need to comprehensively amend the 2012 Law on Legal Education. Regarding the scope of regulation, the Standing Committee of Law and Justice basically agreed with the scope of regulation of the Law. In addition, there are opinions that adding content on policy communication is not consistent with the name of the Law project, because communication activities on policy are in the construction phase, not yet regulated by law and this content has been stipulated in the Law on Promulgation of Legal Documents. The scope of amending the Law as proposed does not address the basic inadequacies of legal dissemination work. Therefore, it is recommended to research and expand the scope of adjustment in the direction of adding support mechanisms so that people and businesses can proactively and conveniently access and learn about the law. Regarding the subjects of application, some opinions in the Standing Committee of Law and Justice suggested considering removing this regulation because it is not really necessary because it has been determined through specific regulations in each chapter and article; Setting an additional general regulation on the subjects of application both causes duplication and does not clarify the scope of the Law. Regarding the content regulating the responsibilities for organizing and implementing legal education work of the heads of ministries, central branches and the Chairman of the Commune Peoples Committee, it is recommended to move to regulations in other laws accordingly; At the same time, it is necessary to review to clearly define the scope of responsibility, avoiding the understanding that the commune level is responsible for organizing dissemination of the entire legal system; Clearly define responsibilities between local governments at the provincial and commune levels, between the Peoples Council and the Peoples Committee at the same level. In addition, the Standing Committee of Law and Justice, the Standing Committee of Delegates Affairs and the Standing Committee of the Economic and Financial Committee proposed to study and supplement criteria and principles to identify subjects with limited access to the law as a basis for the Government to make detailed regulations, ensuring transparency and consistency in implementation./.Nguyen HoangSee moreVietnams Ministry of Justice exchanges experience in conciliation and law dissemination in SwedenSee moreMany forms of law dissemination and legal support for the poorSee moreStrengthening law dissemination and legal aid for the poor
