The provisions in Point a, Clause 2, Article 11 of the Law on Higher Education 2025 are unclear, leading to two interpretations: The first interpretation is that the subject belongs to the school, because the subject is listed. along with faculties in the organizational structure of higher education institutions; Second interpretation, the Law on Higher Education only stipulates that higher education institutions have a subject organizational structure; So the subject in this case can be a school subject or a faculty subject. Depending on the organization and operation regulations of the higher education institution, as long as it meets the criteria of a subject not being an administrative unit. Mr. Vo Cang proposed to answer, which interpretation is correct? Regarding this issue, the Ministry of Education and Training responded as follows: Point a, Clause 2, Article 11 of the Law on Higher Education 2025 clearly stipulates that universities and colleges are called academies with an organizational structure including functional departments, affiliated schools, faculties or Equivalent units and subjects or equivalent units are not administrative units decided by the higher education institution to establish or not to establish. According to the above regulations, the law does not require every university to organize a subject. The establishment or not to establish a subject is within the autonomy of the higher education institution and is stipulated in the regulations on organization and operation of the higher education institution. In case the higher education institution decides to establish a subject, the subject is the unit of study. Technical, not an administrative unit. The Law on Higher Education 2025 does not stipulate that a department must be affiliated with a school or under a faculty.
