At the beginning of session of the Standing Committee on Economy of the State Great Khural the draft law on amendments to the Law on Standardization Technical Regulation and Conformity Assessment Accreditation and the Law on Metrology and the accompanying laws and resolutions submitted It was decided whether to discuss the projects. The project initiators report was presented by D. Amarbayasgalan member of the Government Minister of Mongolia Head of the Cabinet Secretariat. The Consent ActAmendment will take effect on January 1 2023. In connection with the adoption of the Law on Permits the Resolution No. 35 of June 17 2022 of the State Great Khural The Law on Permits Acts of Administrative Norms and the Act on State Stamp Fees and the Law on Metrology Regulating Permit Relations Revised - In the field of harmonization the government was instructed to eliminate duplication duplication and violations of laws to prepare relevant draft laws in accordance with the procedures specified in the Law on Legislation and to submit them to the State Parliament. Therefore in the framework of eliminating conflicts duplications and duplications between the laws that govern the relationship of licensing a total of 89 draft laws to amend the Laws on Standardization Technical Regulation Conformity Assessment Accreditation Metrology State Stamp Fees and other related laws 1 State Draft resolutions of the Great Khural were developed and submitted. In drafting the law relevant ministries and state administrative bodies as well as other authorized entities such as the Bank of Mongolia the Financial Regulatory Commission etc. were involved in the development of the draft law and cooperated with local administrative and self-governing bodies relevant legal entities under public law and professional associations. was presented by Minister of Mongolia D. Amarbayasgalan. The following principled changes have been made in order to eliminate overlaps duplications and violations between laws. The draft amendment to the Law on Permits clarifies the role of the authorized person in providing transparent and open electronic delivery of information about the stages and progress of operations to citizens and enterprises as well as providing opportunities to obtain information from a single point as well as the decision to grant extend and cancel permits. Additional regulations related to the requirements and conditions for granting permits are included. It is necessary to remove 2 special and 3 ordinary permits from the permits prescribed by law and it is appropriate to transfer 2 special permits to the category of ordinary permits. A draft of amendments to the Law on Standardization Technical Regulation and Conformity Assessment Accreditation has been developed in order to set the conditions and requirements in a standard taking into account the purpose of the approval and the level of risk and to meet the mandatory conditions. According to this change the standards of activities for 108 types of special licenses and 7 types of ordinary licenses specified in the Law on Permits will be specially approved and the license holders will have to comply with them. Taking into account the purpose of collecting state stamp fees related to the granting and renewal of permits a draft amendment to the Law on State Stamp Fees has been developed which includes regulations to change the practice of requiring advance payment of the state stamp fee and non-refundable fees if permission is not granted. In addition to the draft law on amendments to the Law on Standardization Technical Regulation Conformity Assessment Accreditation Metrology State Stamp Fees and other related laws in order to bring the legislation governing the consent relationship into line with the Law on Consent and to eliminate duplication duplication and violations A total of 85 draft laws have been drafted. The types and categories of permits regulated by other laws of the sector have been brought into line with the Law on Permits and the regulations for granting permits and authorizations not included in the list but specified in the said law have been invalidated. It was considered that the conditions and requirements for license holders were set in an overly general or non-optimal manner. Also it is considered appropriate to clarify the grounds and procedures for granting extending suspending revoking or revoking permits in accordance with the principle of establishing the procedures for licensing relations in each law. In connection with the presentation of the project initiator S. Chinzorig a member of the State Great Khural asked questions and received answers from the working group. The consent bill was submitted by 22 members of the State Great Khural including S. Byambatsogt on March 29 2019 and by the government on April 30 2019. During the discussion the drafts were combined and approved after the approval of the initiators of the bill. In doing so the government approved the law regulating the basic relations of consent and along with it the government gave the obligation to comply with the law on consent approved on June 17 2022. According to this the working group gave the answer that the above projects are being developed and submitted. The members of the State Great Khural felt that there was no need to speak regarding the discussion of the project so they voted. 60 percent of the members who participated in todays meeting of the Standing Committee supported the discussion of the draft law on amendments to the Law on Standardization Technical Regulation and Conformity Assessment Accreditation and on amendments to the Law on Metrology as well as the draft laws and resolutions submitted together.
