The Ministry of Environment has prepared amendments to the description of the structure and the procedure for issuing special requirements, special architectural requirements, special requirements for the management and protection of the protected area, which will allow to involve representatives of the public in the construction planning procedures.
These amendments have been preparedin implementation of the changed provisions of the Law on Construction, which regulate the issuance of special requirements, special architectural requirements, special requirements for the management and protection of the protected area.
The amendments to the description clarify the cases of mandatoryness of special requirements, refuse a direct application for their issuance, leave the possibility to submit an application only by electronic means, detail the conduct of the public consultation procedure and its deadlines, and eliminate the obligation to submit design proposals, since special requirements will be issued before the preparation of design proposals. It also clarifies the cases in which special requirements are not issued.
The amendments propose to legitimise that the chief architect of the municipality, having identified the need for additional information that the public can provide during the preparation of special architectural requirements, can consult with it. In consultation with the public, the deadline for issuing special architectural requirements would be extended by no more than 20 working days, and the builder (customer) is informed about the decision made in the information system "Infostatyba" no later than within 3 working days from the decision.
The draft of special architectural requirements, together with information about the consultation procedure, the place and time of the meeting, would be published on the website of IS "Infostatyba" and the municipality, as well as this information is sent to the elders and elders of the eldership, the territory of which includes the projected structure. The publicity of the draft of special architectural requirements would take place 10 working days from the moment of its publication on the website of IS "Infostatyba" and the municipality.
It is proposed that no later than 3 working days after the completion of the publicity of the project of special architectural requirements, a meeting is organized at which the draft of special architectural requirements is presented and representatives of the public are consulted on the requirements set out in it, the features of the planned construction site and other aspects. Proposals received by representatives of the public during the meeting would be recorded.
The prepared protocol would be transferred no later than within 3 working days to the chief architect of the municipality, who examines the proposals received during the meeting and, if necessary, adjusts the special architectural requirements.
The special architectural requirements indicate the height of the structures, the number of floors, the density of the construction of the land plot, parking spaces, playgrounds and other playgrounds, parts of dependent greenery and plantations on the land plot and other data.
Comments and proposals on amendments to the description of the special requirements, special architectural requirements, special requirements for the management and protection of the protected area and the description of the issuance procedure can be submitted in the Legislative Information System (TAIS) until April 29.
