Germany Facial Recognition Tender

📄 Tender ID: 498399849 📅 Published: 18 Dec 2023

📋 Tender Overview

Bavaria Digital Minister Dr. Fabian Mehring welcomes the fact that the negotiators at the European level were able to reach an agreement on the AI ??Act: “The new European AI regulation is not a big deal, that was hoped for from this groundbreaking law for the most innovative technology of our time. But it's good that the hanging game is finally over and we all know what we have to prepare for."

Mehring expressly welcomes the fact that the use of AI will be possible in the future, for example for facial recognition in real time in serious crimes or terrorist situations. It is also positive that the so-called AI basic models, which include the GPT language models, will not automatically fall into the so-called high-risk area of ??the regulation. Mehring: “It remains to be seen whether the new AI regulation will allow innovation in Europe to a sufficient extent or how much it will disadvantage our domestic economy compared to tech companies from the USA or Asia. For example, the still unclear definitions of the scope of application and classification into the respective risk category create a lot of uncertainty – especially for small companies.”

On the other hand, the Bavarian Digital Minister sees it as predominantly positive that in the future there will be an obligation to label the AI ??used when writing texts, images and sounds. Particularly risky applications of AI, for example in critical infrastructure, in security authorities or in company human resources, should be controlled and documented by humans.

Mehring: “The use of AI offers our companies an incredible number of opportunities. Now it will be crucial to implement it in the EU member states. Under no circumstances should it be like the General Data Protection Regulation. This time it must not happen that Austria, for example, interprets the law more laxly than Germany.” The implementation offers a lever to make the law a little more innovation-friendly. The federal government is now particularly called upon here.

According to Mehring, the federal government had failed to actively participate in the European debate in a timely manner. Now he must at least ensure that the effects of the new European regulations for companies remain as bearable as possible. Mehring: “It is currently completely unclear which national authority will take care of the implementation of AI regulation and where the experts for enforcement will come from. The traffic light coalition must now finally show that it has recognized the potential of this central future issue for the economy and society. Nothing less than the future of Germany as a technology location is at stake.”
