π Tender Overview
The Ministry of Transport and Communications requests comments on the draft memorandum concerning the national implementation of the EU Data Act. Comments can be submitted until 31.5.2024. At the same time, the Ministry will publish a report carried out by the Research Institute of the Finnish Economy (ETLA) on the markets covered by the Data Regulation in Finland.
The Data Act will bring new obligations for data sharing and rights to use data for many actors and sectors. The act is a directly applicable regulation, so the obligations and rights arising from it enter into force as such in Finland.
EU Member States must designate the competent authority or authorities responsible for monitoring the application and enforcement of the act. In addition, penalties must be laid down for breaches of the obligations of the Regulation. The duties of the authorities in the act are partly new.
The draft memorandum reviews the implementation of the Data Act in Finland. The draft memorandum focuses on the tasks and powers of the authorities and the division of duties between the authorities. It also assesses possible legislative needs arising from the Data Act at national level.
The working group of authorities that drafted the memorandum proposes that the Finnish Transport and Communications Agency Traficom become the main supervisory authority for the Regulation in Finland. In addition, the Act would give the Data Protection Ombudsman new supervisory tasks.
The Data Act is part of the European Commission's 2020 Data Strategy. The aim of the act is to promote a data-driven European single market. It is a horizontal piece of legislation that sets rules for all sectors that use data.
The aim of the act is to promote the fair distribution of data between data economy actors. The act aims to stimulate the development and innovation of new, innovative connected products or related services.
