Mr. Luu Viet Hieu (Hanoi) asked, whether the owner of a private preschool must pay social insurance for teachers? If it must be closed, what is the procedure? In this regard, Vietnam Social Insurance answered as follows: Based on the provisions of Points a and b, Clause 1, Article 2; Clause 1, Clause 2, Article 21; Point a, Clause 1, Article 99, the employee working under an indefinite -term labor contract, a definite term labor contract, seasonal labor contracts or a certain job with a term of 1 month or more are subject to compulsory labor contracts. Accordingly, the employer (owner of a private preschool) has concluded according to one of the above-mentioned labor contracts, they must participate in compulsory social insurance for teachers in accordance with the law. SPECIFICATION OF EFFECTIVE:-Workers: Declaration of participation, adjustment of social insurance and health insurance (health insurance) (form TK1-TS) .- Unit (private preschool):+ Declaration of participating units, adjusting information of social insurance and health insurance (form TK3-TS);+ Report on labor use situation and the list of laborers participating in social insurance, health insurance, unemployment insurance; Profile for the social insurance agency where the unit is headquartered. Form of submission: Submit directly at the one-stop part of the social insurance agency, by post or online via the Vietnam Social Insurance Portal or through I-VAN organization.
