Legal land documents for granting construction permits have been stipulated in Article 55 of Decree No. 217/2026/ND-CP dated June 19, 2026 of the Government detailing a number of articles of the Construction Law on management of construction activities (effective from July 1, 2026). The land plot of Mr. Tran Tuyens family (Dong Nai) is land. In urban areas, it has been used stably since 2008 until now. There is a house on the land that has been built and used for more than 10 years. However, the house is now seriously degraded (no longer able to be repaired), posing a potential safety risk for family members. According to local information, Mr. Tuyens familys land has been planned as urban residential land. However, when contacting the ward cadastre to carry out procedures for granting a Land Use Rights Certificate, he was informed that he still had to wait for approval from superiors before being able to issue the book. The current housing condition is too degraded, his family cannot continue to wait any longer due to the urgent need for accommodation as well as the need to ensure safety. Mr. Tuyen asked, in case he has not been granted a Land Use Rights Certificate but the land has been planned as urban residential land and the family has lived stably since 2008 until now, is he allowed to build a new house? If construction is allowed, what procedures do families need to follow? Which agency has the authority to resolve, and what documents need to be prepared? The Ministry of Construction answered this issue as follows: Legal land documents for granting construction permits have been stipulated in Article 55 of Decree No. 217/2026/ND-CP dated June 19, 2026 of the Government detailing a number of articles of the Construction Law on management of construction activities (effective from the date of July 1, 2026).
