The time to confirm a completed contract to determine a similar contract is the time of goods acceptance, not based on the time of contract signing. Mr. Huynh Tan Tai (HCMC) requested guidance on how to determine the completion date in a similar contract according to Form No. 04A issued with Circular No. 79/2025/TT-BTC. In reality, there are cases where a contract has an implementation period of 12 months. from the date of signing, but can be completed early or accepted and liquidated later than the deadline. Mr. Tai asked, is the completion date in a similar contract determined to be the end date according to the contract term, or the actual date of acceptance and liquidation? Regarding this issue, the Ministry of Finance has the following opinion: According to the instructions in note No. 11 Table No. 01 Chapter III Form EHSMT for online procurement of goods issued with Circular No. 79/2025/TT-BTC dated August 4, 2025 of the Minister of Finance guiding the provision and posting of information about bidding and bidding document templates on the National Bidding Network System, a completed contract is a contract with all goods that have been accepted or a contract that has been liquidated.
