π Tender Overview
After partial checks, which my Office carried out, on the legality of the installation and operation of a Closed Circuit Video Surveillance (CCBP), which included gyms, and after evaluating these results, I quote the following:
The operation of CCVs in gym facilities should aim to ensure the protection of those facilities and should respect the right of customers and employees to the protection of their privacy and personal data.
In particular, weighing the legitimate interests of the gym against the rights of the data subjects, the operation of a CCBB in the area where the machines are located and the recording of natural persons during their training is considered excessive.
In light of the above, CCBB may be operated in:
Gym entrance/exit,
Parking space (provided that its use and/or management is under the responsibility of the gym),
Around the gym, recording within the boundaries of private property,
Reception, focusing exclusively on the cashier.
The operation of CCBPs is not allowed in:
Areas with machines/areas, in which natural persons exercise,
Kitchen
Toilets/changing rooms,
Offices.
Please note that audio recording is not allowed under any circumstances, as this excessively interferes with the privacy of data subjects.
As far as access to the audiovisual material is concerned, it must only be possible to obtain it from a screen/computer, which is located within the gym premises and to which only the Director and/or an authorized person has access. You may not access such material from a personal device and on an ongoing basis.
