Hanoi responded as follows: According to Clause 1, Article 72, Decision No. 505/QD-BHXH dated March 27, 2020 of Vietnam Social Insurance on amending and supplementing Article 46 of Decision No. 595/QD-BHXH regulating the recording and confirmation of payment time of social insurance, unemployment insurance, labor accident insurance, and occupational disease in the social insurance book as follows: For units with delayed payment Social insurance, unemployment insurance, labor accident insurance, occupational disease, if the employee is eligible to receive social insurance or terminates the labor contract, the working contract, the unit is responsible for fully paying social insurance, unemployment insurance, labor accident insurance, occupational disease, including late payment interest according to regulations, the social insurance agency confirms the social insurance book to promptly resolve the social insurance and unemployment insurance regime for the employee. In case the unit has not paid in full, then Confirmation of social insurance book up to the time of payment of social insurance, unemployment insurance, labor accident insurance, and occupational disease. After recovering the amount of late payment from the unit, additional confirmation will be made on the social insurance book. Thus, in case the company is late in paying social insurance, it will be responsible for prioritizing the completion of the late payment of social insurance for employees who leave their jobs. At the same time, the company must perform the responsibility of closing the social insurance book so that the employee can continue to participate in social insurance. Ms. Trang can request the employer to confirm the social insurance book until the time the unit fully pays social insurance for the employee. For the months in which company A still owes social insurance contributions, the social insurance agency has not temporarily recorded the corresponding payment process. After moving to company B, her process of participating in social insurance continues to be recorded and closed in the normal social insurance book, independent of the outstanding social insurance payment obligations of company A. The fact that the company owes social insurance for a long time and has not been able to close the separate sheet will directly affect benefits such as maternity, sickness, or unemployment benefits (UI)...
