Mr. Vo Chi Thanh is the Head of the Forest Protection Management Station under the Protection Forest Management Board, directly working on forest management and protection, forest fire prevention and fighting in the area. Mr. Thanh is holding the rank of specialist, has not been transferred to the professional title of Forest Protection Management. He asked, is he entitled to a specialized allowance for forest protection according to Article 66 of Decree No. 42/2026/ND-CP? He was appointed as Deputy Director of the District Protection Forest Management Board from January 1, 2012, and by 2016 was the Director, directly working on forest management and protection, forest fire prevention and fighting in the area. After that, due to the arrangement and merger of the provinces protective forest management boards, Mr. Thanh was appointed as Head of the Forest Protection Management Station under the Protection Forest Management Board. Mr. Thanh asked, if he is entitled to an allowance for specialized forest protection according to Article 66 of Decree No. 42/2026/ND-CP, will this time be counted for seniority allowance? The Department of Forestry and Forest Protection, Ministry of Agriculture and Environment answered this issue as follows: following: Point a, Clause 2, Article 16 of Decree No. 01/2019/ND-CP dated January 1, 2019 of the Government on Forest Rangers and Forest Protection Task Force (amended and supplemented in Article 66 of Decree No. 42/2026/ND-CP) stipulates: Officers of the forest owners Forest Protection Task Force are entitled to salaries and allowances like Forest Rangers (except for civil service allowances). and other regimes as prescribed by law. Accordingly, the applicable subjects are officials of the Forest Owners Specialized Force for Forest Protection, organized and operating according to the provisions of Article 14 and Article 15 of Decree No. 01/2019/ND-CP. Determining subjects and conditions for applying salary and allowance regimes such as Forest Ranger and other regimes is done based on job position, professional title, assigned tasks, implementation of forest management and protection tasks and application conditions according to the provisions of each regime and policy; At the same time, comply with the law on wages, allowances and relevant legal regulations. Currently, the seniority allowance regime for Forest Rangers is implemented in accordance with the provisions of Decree No. 76/2009/ND-CP dated September 15, 2009 of the Government amending and supplementing a number of articles of Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regimes for officials, civil servants, public employees and the armed forces and Circulars. Joint No. 04/2009/TTLT-BNV-BTC dated December 24, 2009 guiding the implementation of the seniority allowance regime for civil servants who have been ranked according to the ranks or specialized positions of court, procuracy, auditing, inspection, civil judgment enforcement and forest rangers. The preferential allowance regime for occupations is implemented according to the provisions of Decision No. 132/2006/QD-TTg dated May 31, 2006 of the Prime Minister on preferential allowances according to occupations for civil servants and officials in the forestry, plant protection, veterinary and dyke control sectors and Joint Circular No. 64/2006/TTLT-BNN-BNV-BTC.
