π Tender Overview
o Initiative may affect mining exploration activities, weaken competitiveness and damage the sustainability of the sectorThe Ministry of Energy and Mines (MINEM) expressed its concern about the ruling of the regulatory proposal that seeks to modify the mining concessions regime incorporated in the General Mining Law, urging that this initiative be reviewed comprehensively in order not to cause negative impacts on the sustainability of the mining sector.
The MINEM explained that, within the framework of the debate in the Energy and Mines commission of the Congress of the Republic, it maintained that these regulatory changes are not technically viable, and that the proposal to reduce deadlines to declare the expiration of a concession could weaken Perus competitiveness compared to other jurisdictions.
He added that the initiative can generate negative effects, such as an increase in conflicts over concessions and greater incentives for illegal occupation, in a context where the State has established, as a national priority, the fight against illegal mining that is spreading in the country.
Likewise, it can directly affect mining exploration activity, a key stage for the discovery of new deposits, which would directly affect the future sustainability of the sector and the strengthening of the national economy.
The governing body of the mining-energy sector specified that the adoption of measures that do not consider the operational reality of the mining sector, and its permitting, generates uncertainty for formal investment and affects the legal stability of the country.
He emphasized that proposed measures, such as the reduction of deadlines to prove production or minimum investment, the increase in the validity right progressively according to extension, and the significant increase in penalties, require a technical and economic evaluation of their impact.
The MINEM reaffirms its commitment to modern, formal and sustainable mining, and highlights that any reform to the concessions regime must be based on technical criteria, regulatory predictability and promotion of responsible investment in the strata of large, medium, small and artisanal mining.
The MINEM calls for deep reflection so that the proposal is comprehensively reviewed, in coordination with the Executive Branch and all actors in the sector, in order to ensure a balanced regulatory framework that encourages investment, guarantees the efficient use of resources and effectively contributes to the fight against illegal mining.
He recalled that in the mining sector on a global scale there are many countries that compete to attract new capital and unlock projects in the exploration or use of critical minerals; Given this, Peru must continue advancing to consolidate itself as a competitive and attractive country for mining investment, with predictability and legal security.
