Contract awarded for digital platform for fleet management as well as maintenance The acquisition of a "digital platform for fleet management as well as maintenance" the duration of the sectoral supply contract will be 12 months from the date of its signing and will end after the completion of the award procedure for the supply contract under the following condition: suspensive clause - the conclusion of the contract is conditioned by the signing of the additional act modifying the financing contract no. 45/13.12.2023 based on note no. sinv/1/174/23.04.2025 which approved the proposal to modify the financing contract no. 45/13.12.2023 for the project of modernization of 55 electric locomotives intended for towing passenger trains, conversion of 20 hydraulic diesel shunting locomotives into electric locomotives with batteries, and modernization of 139 passenger cars, financed through the national recovery and resilience plan component 4 - sustainable transport, annex no. 1 - project sheet. In case, regardless of the reasons, the financing contract no. 45/13.12.2023 is not modified by an additional act according to the provisions of note no. sinv/1/174/23.04.2025 within a maximum period of 60 days from the date of approval of the procedure report, the award procedure will be annulled by law in accordance with the provisions of art. 225, para. (1) lit. c), second thesis of law 99/2016 with subsequent amendments and completions, making it impossible to conclude the sectoral procurement contract. The bidders in this procedure understand that sntfc "cfr calatori" s.a. cannot be held responsible for any damage in the event of the annulment of the award procedure, regardless of its nature and regardless of whether sntfc "cfr calatori" s.a. has been notified of the existence of such damage. The bidders in the procedure accept the use of the above special conditions/suspensive clause, assuming full responsibility regarding any damages they may suffer in the described situation. The economic operator may request clarifications 18 days before the deadline set for submitting offers and the contracting entity will respond clearly and completely to all requests for clarifications/additional information 11 days before the deadline for submitting offers.
